If you are using or occupying land that you do not legally own, you may be able to make a claim for adverse possession to become the land’s legal owner.
What is adverse possession?
Adverse possession arises where you occupy a piece of land that you do not own and do so without the landowner’s permission.
There are many different scenarios in which adverse possession can occur. For example, you may have been using a neighbouring plot of land for many years without anyone coming forward as the owner.
If you have been occupying land in this way, you may be able to apply to HM Land Registry to become the land’s legal owner. This would be an application for adverse possession.
If your application is successful, you will be registered as the legal owner of the land and able to use it as any owner would.
How do I successfully claim adverse possession?
To succeed in a claim for adverse possession, you must satisfy certain criteria. Some of these include not having permission from the landowner to use the land and having used the land for at least 10 years.
If the land you occupy is unregistered, you will be required to have been using the land for at least 12 years.
