Over the last two years, there has been an increase in clients using ChatGPT to draft legal documents, including Separation Agreements, Pre-Nuptial Agreements and Consent Orders.
Although these documents may initially look very similar to an agreement prepared by a lawyer or an order that would be made by the Court, there can be subtle but important differences.
One of the disadvantages of using ChatGPT is the risk that it may produce incorrect or factually inaccurate information. For example, an order may not provide for the dismissal of all financial claims, i.e. a Clean Break, as intended. It may also include additional agreements that are not enforceable.
This highlights a potential limitation of AI and why the importance of seeking independent legal advice when preparing such vital documents following separation cannot be underestimated.
